Amp’d Bankruptcy Filing: Verizon Wireless Largest Creditor With $33 Million

Amp’d Mobile’s Chapter 11 bankruptcy filing in U.S. Bankruptcy Court in Delaware has a wealth of info on the company’s creditors, and a list of shareholders of the company (we broke the story first here). According to the court documents, Amp’d owes about $33 million to its infrastructure/network provider Verizon Wireless, followed by its handset provider Motorola—$16 million; Vivendi about $10 million, BestBuy about $8 million; MTV Networks about $1.8 million; and others. In total, the total debt is more than $100 million. Amp’d says its assets total less than $100 million.
As for the shareholders, CEO-founder Peter Adderton (through his trust) holds the largest share of common stock, just above 5 percent. RedPoint Ventures holds around 3 percent plus more acrued through various equity rounds. Other shareholders in five subsequent rounds are also listed ... in addition to VCs Redpoint, Highland Capital Parters, Columbia Capital, these include creditors MTV Networks, Qualcomm, Vivendi Universal, Best Buy and many others.

    it would be interesting to find out how much due diligence all those investors actually did on the company and its business model etc before they invested as opposed to getting caught up in the hype of hollywood parties and free tickets to the motocross.

    I am really shocked, but had a gut feeling that this was happening not to long ago, as an employee I knew something was sketchy with the way things where going on. They made up excuses of why certain things, where the way they where, like being low on phones accross the u.s, and not paying employees on time. Shame on Peter Adertton, for knowing, and allowing this to happen. good job making sure all of your friends, where debtors, as well, especially since you hold the most stock. here ya go, lie on reports, get investors, keep the money, owe debtors, never pay debtors, what you owe. Good job, thanks for showing the 18 to 35 how to do business. They really believed in this up company, as one of the front faces for you, you really make me look bad.

    James, couldn’t have said it better myself.  I am willing to bet that very little diligence was done on this by the Vcs. They all probably got caught up in the fancy MTV parties, hanging out with rappers that Amp’d worked with, etc etc.

    I’m betting that there will be lawsuits coming and some of the VCs will have to answer some serious questions around oversight, audit committee activities etc. Failures like this dont happen overnight. It took many months of terrible accounting and controls to get to where they are.

    I bet some VC careers will be over as a result of this one as well.

    Will this deal become the poster child of of the current “boom”? Much like eToys or Pets.com were 6 years ago? I think some of the same investors are involved in this deal as some of those past failures too.....

    If you ever dealt wih their customer service department, you would be able to see why they can’t make any money.  I called to resolve an issue- a billing mistake of more than $500-and was told to call back in two to three weeks to give them time to look into the matter.  The lady I spoke to was very helpful-but she could not restore my service, even though it was their mistake.  So here I am with a phone I can’t use and getting billed on my charge card for service I don’t have.  I’m sure there are plenty of others who have the same complaint-actually it is a good way to raise capital-just rip off your customers!

    Yeah, I too paid the bills on time and recieved a letter from amp’d stating that I haven’t paid on time.  I called several times concerning this matter and the problem was no resolved. I’ve gotten tired of this company and changed providers. If anyone has the same problems as I do please let me know. There could be a “Class Action Suit” against this company. I don’t want it to affect my credit.

    I would like to know how to file a class-action lawsuit against amp’d mobile. I brought 3 phones on the hybird plan and it started acting up as a pay-as-you-go plan, eating all the money in a matter of days. When I call to ask for credit, I get cussed out, hung up on, and told I must make payments before i can use the phone again. It would be nice if we all could get together and do a class-action lawsuit. I also got charged for a 4th phone that I never brought and I am still fighting for my money back on that one.

    I’m just one of the poor slobs that purchased a phone and the service. I’m not out millions, just the $100 dollar mail-in rebate (and the more than $100 in cash) I payed for the phone...plus the time wasted on the calls for service and waiting for online help. 

    And I’m still waiting for that call from the tech they promised would make all the problems go away. Looks like the problems won’t be fixed; but they will be going away...along the company.

    I’m one of the few “cell phone challenged” people left in America. I only use one when I need to. I’ve waisted money on plans. I’ve waisted money on other pre-pay providers. However, I do like having one for emergencies. Friends and family say, get rid of the home phone and go cell phone only. Maybe I will...after I get that rebate I’ve been waiting seven months for!!!

    i purchased an amp’d mobile contract in september. i’ve not received a rebate, i’ve not received a replacement phone that was supposedly sent out twice because the phone is so glitchy it’s practically unsusable. i was told theres no way to find out if you’ve over-gone your minutes. my phone’s been shut off now for a month because i’ve not paid my bill due to this. 4 times i asked about my rebate and 3 times i asked about the phone. i was told to email some third party company about my rebate and never received a response. they said they couldnt find my information in the system for the rebate. the internet customer service tells me theres no way to verify my account online so i have to call in. and when i call i’m on hold for over a half an hour to get the same response every time. has anyone else had these kinds of problems? if so is there any kind of class action against them for this?

    I think its class action lawsuit time… Missing rebates, hybrid plans acting like prepaid plans, cant check your minutes… Poorly run company, I think Verizon forced Ampd into bankruptcy so they can get 200,000 new customers to get ahead af AT&T;(with I Iphone). Thus if Verizon says we got 200,000 subs and AT&T;only got xxx,xxx amount with the most anticaptted phone in years, clearly the I-Phone is a flop other wise why do we have more new subs then at&t;

    I have been waiting for my $100.00 rebate for 6 months. The rebate form said I would recieve this in 6 to 8 weeks, not six to eight months.  This is starting to seem like a scam from the start.  Pre-planned to steal from the working class.     This is by far the worst, most dispicable, if not criminal company that I have ever encountered. I was over-charged by hundreds of dollars on my first bill, and after spending hours and hours on hold, being hung-up on and being shut down twice, I was told I’m not getting any credit ! Then the supervisor said, if I don’t like it I can go to another company and pay them $600.00 for early termination of my contract !! I have already filed complaints with the Better Business Bureau and the FCC. As far a a class action law suit goes .... I’m in!!

    Class action has got to be next for us--the customer.  Damn the investors and everybody else!  My service was suspended on the 26th of june.  For no reason, I might add!  I got someone on the line after an hour of waiting and she said she restored my service-=--NOT.  I have tried to get tech support on the line for three days.....no answer....I got someone on the line from billing and they even said tech support number no longer works.  I have been trying to port my number over for two days and it can’t happen because my NEW phone company can’t even get AMPD on the phone!!!!! What’s going to happen when AMPD keeps sending me a bill!!!  Write them a letter demanding your service to be terminated due to poor serivce and write as much detail as possible, then send it certified mail----Then at least you have some sort of documentation....fortunately I haven’t lost any money YET--untl they try to bill me for early termination fees and next months bill that I haven’t used.  If anyone knows how to start a class action law suit DO IT!!  My email is please keep me in the loop!

    Boy I’m glad that I’m not alone.  My husband signed up for Amp’d service and new phones in January.  Then he found out that the phones were backordered-so he cancelled the order.  Then he got the runaround for months about the refund.  Finally he got fed-up. Then I got involved, and I thought that I had finally gotten through to billing that I was owed a refund. They said they would send me a check.  Now I have called the number for billing several times, and it goes to Verizon- it is a discontinued number.  I think we should all go after Verizon, Motorola, MTV, and all the other big shots.  They were the ones who promoted Amp’d in the first place- they should have to pay us.

    Today my phone was shut off (outgoing calls) even though my bill is paid and I am up to current. Incoming calls work fine. When I try to make an outgoing call it pauses and the after about 20 seconds tell me “All circuits are busy, please try your call later” and then the call automatically disconnects. If I call 611 or 1-866-811-0091 (Both are supposed to connect you to AMP’D customer service) all I get is a busy signal or a disconnection. This happens even if I call the 1-866 # on another phone other than my cell. What the F*%K is going on? Is anyone else having this problem? Try calling 611 from your phone. Do you get a busy signal (during their business hours)??? Anybody having this same issue or have you had it in the past? I am about to go get a new provider tomorrow. I am very knowledgeable when it comes to dealing with being turned over to a collection agency and what ones legal rights are. If anyone has a bill that they are fighting AMP’D with and you get turned over to a collection agency e-mail me. I have a letter that can be sent that will take the collection agency off of your back and will do no harm to your credit by doing so. e-mail me: .     i have to say I am very upset about this...my friend did keep telling me, “why are you on that cheap ass ampd mobile?” and guess what she was right. listen ppl im only a teen and I got my phone for christmas...I need my 200 dollars back and all the money i spent on prepaid cards! they need to fix this...they arent ever going to pay that money off...and they need to give everyone a refund! this is really crappy and I dont appreciate it...I really like this phone...and by the way it took my mama like twenty million calls to try to get the rebate and they finally sent it...but what a hassle! they need to reprimanding all refunds to customers, go public with an apology and get out the phone business...period.     I’m so glad I found this site. I, like alot of you, purchased the Motorola Razr in March and have yet to see my $100 rebate. It was in the “Processing” mode for weeks and now I can’t even access Amp’d Mobile’s customer service site or get them on the phone. I should’ve taken my first interaction with them as a clue of what was to come. My daughter got a Razr for her birthday from her aunt (who is also still waiting for her rebate) and the first time I loaded her account for $20 my checking account was debited $100. I’ve yet to see that credited to my account. These people are a bunch of idiots. I have no idea about how to start a class action suit, but I will be doing some investigating starting today. I’ve made a note of some of your email addresses and will email you when I have some information. This cannot be tolerated and if we let it go it will only happen again.

    i Bought a hybrid plan $49.99 5 months ago,when i called to activate the service the employee took my credit card info and after that she said that her computer was having problems and that i will have to call back to activate,i called back,they took my credit card info again and my service was activated,when i checked on my bank i got charged $50 twice of course,i have been calling for months now and they are telling me that there is a third company that manage the refunds,that there is nothing they can do about it.In top of that i have been charged 45 cents a minute for a hybrid plan for the last 2 months,today i finally contacted a technician and he told me that my problem is fixed and that he had to charge me $50 to get my Hybrid plan rolling and working.He charged me the money and guess what,after i hang up i check my minutes and didnt get any minutes credited.Another $50 stolen.I called customer service and they tell me that they are sorry.I have the employees names and badges numbers.May be it is just me ,but i consider this steeling.If somebody steel $10 from me on the street i just have to call the police and they will take care of it.This company stole $100 from me.Who i call?What i do?Is there any law that consider this as steeling??????

    Back in early March 2007, I bought a phone for my daughter (promising a $100 rebate). I sent this rebate in and they received it on 03/30/2007.

    My daughter also filed a rebate for signing up for service. It was also a $100 rebate. That was sent at the same time as mine. But it was received on 03/19/2007. They’ve told me they were expitiding hers and mine would follow shortly after.

    And the minutes that my daughter would have on her phone would just slip away on their own. We thought this was happening and I even made her shut it off and put it in a drawer. Sure enough.... every time she would go back and check the meter it would tell her she had $.10 - $.50 less than she did before. These add up and she couldn’t wait to get the rebate to get rid of the phone.

    I have been watching the website to find that it has been processing for the past 3 1/2 - 4 months!  I have called the phone number supplied for web-rebates several times and stayed on hold for 45 minutes to an hour each for them to they tell me 2-4 weeks EVERY time that I call. Now, after waiting yet another 4 weeks, the number is no longer available (only a message saying to check the website). 

    And now I hear they aren’t even honoring the rebates!  How can they get away with that?!  I would definenately be interested in filing a class action lawsuit against this company.  Any ideas on how to get one started?

    I purchased a phone in March and am waiting for 100 rebate. I filed complaints with attorney general, and better business bureau. Today I get a text message from amp’d. “You have been waiting too long for your rebate, allow us to give you a 100 credit +20 extra credit.  Press y on your phone to accept. I am tempted to take this credit, as I know I will never see a rebate check.  Does anyone know what is going on with company? I am due to reload my minutes. I am afraid to do this as I wonder if Verizon will just pull their service, and I will be out 20 more dollars. Do you think company could be bought out? If I knew that company would be bought by Verizon or someone else I would then reload minutes. I have contacted FCC, Verizon etc and cannot get any info about the future of Amp’d.

    I know exactly what you are all talking about.  I purchased my phones, thats right 2 phones, in December.  I was told when I signed up that the first month was free.  I had unlimited texting and unlimited night and weekends.  I was only supposed to pay 115 a month which was fine by me.  So January rolled around, no bill, I thought it was because of my first month free.  Febuary no bill I tried calling to find out what the deal was and didn’t even get crappy music.  The phone just kepted ringing and ringing.  Finally about mid May my phone shuts off when I go out of state!  that really ticked me off!  finally my fiancee gets someone on the line and they tell him that they sent my bills to my e-mail and which was going into my junk folder.  I don’t even open my junk folder to see if I have BILLS in it WTF!!! They tell him that it was shut off because I owe $1550.  Well just yesterday I get a letter in the mail from a collection agency saying I owe $1856 and some change!  after 4 months I should only owe at most with a $200 early termination fee-$660!!  I am calling a lawyer this crap is BS and I for one am not going to put up with this!  If I wanted to be screwed over I would have saved money and payed for a male hooker!! FTS!!!  If your with me on this e-mail me I am calling a lawyer today!

    ERGGGG Ampd has screwed us all over. I am glad Im not the only person. I hate this company with a passion. I signed up for one phone and it was great, I had no problems what so ever with it, even though customer service was terrible. I never got overcharged or anything. Until about three months later I got another phone from them. This was a razr phone. Luckily I only paid twenty dollars for it (through BEST BUY). They signed me up by “accident” for a pay as you go plan. So when i found out this was wrong I went and got a new phone for free with a new plan. They made it a 50.00 a month plan which was fine. Then I called a month later and had it changed to a 150.00 a month plan that was meant to be unlimited. MY ASS. We used the phone thinking it was unlimited but NOOOO so I got charged 780.00 in text messaging alone. Talk about a rip off.  So after hassling with them they said they fixed it. ANOTHER LIE..whats new though right?...So my total bill is $1965.00!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Someone please tell me how to file a class action lawsuit. Someone needs to get some sort of Petition so we can all have our names down to get one started. I have another question..Do we have to pay our bills if they go bankrupt? Please let me know. I am pissed.

    Is there still n Ampd mobile class action suit happening?  I’d like to know where I can sign up.  I am currently on day 5 of waiting for Ampd to port over my number...which is apparently, illegal.  They are holding it for ransom because they overcharged me by about $550 and I’m not paying until I see them in court.  I’ll be filing a small claims request next week. 

    This is one of the most awful experiences with any company of any kind that I’ve ever had.  Please let me know if anyone else is ready to take these guys to court.

    my email is .  I am looking to be apart of the action suit against amp mobile.  It really isn’t fare for customers who have families or customers who don’t but spend large amounts of cash to receive a service that you never get but your money is gone to these executives who don’t care about our needs.

    What needs to happen is the rest of the 160 million that they have needs to be split to us the customers.  Its a shame that people can get away with things like this and we need to pay them back with a lawsuit.  Hit me up and lets make that happen.

    Add me to the list of victims. Hybrid plan, acting as pay as you go, billing dept is helpless, tech dept refers me to billing agent, billing agent tells me I forgot a form. I’m leaving the US in a few weeks anyway, which means that to remain reachable I’ll have to pay another 20-70 dollars and use their pay as you go since that is how I am being billed.

    My fault. Had I seen this Chapter 11 filing business I’d have stopped using the phone when my last (June) payment ran out.

    There is no one to sue; they are going to fly by night and they are in essence financing their business (ie keeping it alive for a few more months on life support) by using Chapter 11 fraud.

    Amp’d announced in an employee meeting today that it has essentially lost its struggle to stay afloat.  Amp’d has conceded that on Monday, Verizon will prevail on its motion in BK court to kick Amp’d off of the Verizon network.  All Amp’d customers will immediately thereafter lose their service.  Amp’d will lay off all of its employees at the end of July.  Any remaining assets will be auctioned off.

    Three cheers for the wealthy Amp’d executives who hosed Amp’d’s investors, customers and employees then escaped to Australia.  Live it up guys!

    I wrote this to the BBB of Los Angeles the 1st week of May.:

    We have been over-billed by hundreds of dollars since
    we started with Amp’d last year.  Despite a plan for 1000 minutes, we have
    been charged while well UNDER those minutes.  Their customer reps tell us
    they will correct the problem, yet each month the same thing again!  Only on
    the bill before last did they even include the plan name.  I’m beyond
    frustrated!

    They basically said that since Amp’d said they resolved the situation with us...they DID!  Imagine.  Getting screwed by both Amp’d AND the LABBB!!

    Like the rest of you, I’ve had it.  I fear though that after Monday there won’t even be a way to port my number elsewhere.  With all of this going on, are we still liable to pay our bill with Amp’d?

    Short version of your story : i signed up for a contract that was supposed to include nights and weekends. when i got my first bill, it came out to be $500+ and then i called and they said the unlimited nights and weekends were not included, but i told her i signed up for it and it was written in my contract, she then told me to fax the contract over 2 their corporate and it would have 2 take about 60 days for them 2 review and resolve it and then they would credit me asap. but she said in the mean time i would have to pay the $500 within 30 days or my phone would be turned off. In my knowledge, I don’t think this is fair and who knows how much time it would take to get refunded. in my matter, i think they should review my contract that i fax to them and phone calls i made through night and weekends and send me a revised bill. But they said they want the full amount thats on the bill before they credit me. what if someone doesnt have $500 and did not expect to pay that much on the bill.

    Verizon Wireless, frustrated by the failure of Amp’d to line up a bankruptcy loan, wants to disconnect the startup once and for all, according to a new brief filed in the court, picked up by AP. Despite the Delaware bankruptcy judge saying earlier this month Amp’d can pay $2.5 million to VZW and continue to use the network while it reorganizes under Chapter 11 protection, VZW now says Amp’d is racking up charges of $370K a day, and now owns $15.6 million in charges in addition to the $33 million at the time of bankruptcy filing 47 days ago.

    “Based on the record of this case and the fact that (Amp’d) has been given ample opportunity (over 46 days) to secure debtor-in-possession financing which has not materialized, this court should not permit this case to be run for a single additional day on Verizon Wireless’ back,” Verizon said in the papers filed yesterday. Amp’d Mobile will have just $9,000 in cash as of next Monday, Verizon Wireless said. “The reality is that the debtor has no funds with which to pay Verizon Wireless absent a ‘real’ debtor-in-possession loan or an infusion of equity--neither of which has been made available.”

    Folks I got the hose too! I was a dealer for them that actually never got started. I invested more than $12,000 into remodeling a store that would be an exclusive AMP’D Mobile outlet. My Master Agent never told me that the last commission check they received was in March of this year. So, I not only invested the money to remodel the store I also purchased several thousand dollars worth of phones to sell. I was being told and even as late as this morning that everything is ok “just sell the pre-paid.” I can’t get Verizon or AT&T;due to them telling me there is not enough room in the market place in my hometown. T-Mobile, Sprint and all the others do not work well enough for me to be a dealer for them. If it won’t work good enough to satisfy me I won’t sell it. Well, all I can say is thank you AMP’D Mobile and Airtel Wireless for helping me to go out of business and loose a butt load of money in doing so!! What it amounts to is that one day these greedy bastards who lied to all of us, including my Master Agent, will have to explain to someone with a whole lot more power than me!

    Okay. So now that we’ve all been screwed by Amp’d mobile I have a stupid question. I bought 2 razrs from CC that, we have pay-as-you-go plans so I had to buy the phones outright. Can we still use these phones with another wireless company? I really don’t want to have to drop another $500 on new phones.

    I have bought 2 monthly phones from amp’d. Within the first month, both if my phones were acting up and they refused to replace them. I ended up sending them to the manufacturer, Keyocera, who provides a full year warranty. Currently, amp’d owes me 130.00 from a mistake that they made, I ended up paying it to avoid disconnection. I was told that they would give me the credit but it would take a few weeks. I have not heard anything regarding my credit and everytime I call back it’s like I’m starting a claim all over again. All my bills have been paid. Amp’d is full of shit. If you guys follow up on that class action suit count me in!

    Rumor has it technical support is no longer is able to support business hours during Saturdays. They now have management picking up the phones, saying nothing and hanging up on clients who have been waiting for hours to talk to someone in technical support.

    This is not surprising.

    I also just found out that all the vendor who were selling Amp’d service have not been paid for any of the contracts that they had sold. I gather this information from Westerfiled Management.

    Plus I have spoken to many Amp’d employees and many of them feel that they are not being told the truth about Amp’d financial situation. Plus many of them are now looking for other jobs because they can’t handle the load of upset clients calling in screaming at them about Amp’d unable to resolve many of there problems . There is even the possibility that they might lose a couple of weeks of pay if the company goes under.

    Does anyone see a sinking ship?

    Hello,

    I am interested in a class action lawsuit. I purchased a phone (RAZR) to which I have yet to receive a rebate check for. The dates published for the rebate offer were between 12/09/2006 and 05/31/2007. I purchased and sent in the rebate in advance of the deadline. After reading the horror stories of the rebate “scandal” I decided to pay a little extra, and sent it certified mail, return receipt. As of 7/21/2007 I have no check, and logging into the URL provided to obtain information on the rebate process, it is at step 2 (of 4), also given is the last postmark (possibly the last time that anyone updated the account?) of 06/30/2007.

    I have been with a previous seller/reseller of prepaid phones. So I am not new to this scenario and there are certain things that need to be addressed for me to be “OK” with AMP’d going under. As with my previous phone, the initial cost was substantial. This would not be an issue if the phones were not locked, or had simm cards as is the case now with AMP’d phones.

    In no particular order here is what I want in order to be satisfied.

    Everyone should get a $100.00 rebate check that met the guidelines. Period.

    AMP’d MUST have a number that actually connects you to a live Tech that can, and will allow you to unlock your phones for use on a 3rd party network. This number MUST be toll free.

    AMP’d MUST set up a billing dept and hot number line to DEAL with and correct billing issues.

    AMP’d MUST be ordered by court to cease any and all collection attempts. If they cannot support the product, and or correct billing issues, they should not be allowed to “screw” over the end user. Collecting money, and in some cases robbing people of money, and or ruining their credit while not providing adequate support to remedy billing errors IS criminal.

    AMP’d MUST be ordered to REFUND the remaining account balances if they no longer have a network (read, Verizon cuts them off). AMP’d should not be allowed an indefinite amount of time to “make payments”.

    An outside investigation should be conducted on all levels, especially in the area of overbilling, and incorrect billing to determine the cause. If it was made in error, why not correct them? Or is it a capital gain scheme? The truth needs to be made public knowledge. Period.

    The above is just a start. But I feel customers should not have to wait a month to get the above completed.  As a customer I know this ship is sinking, whether it still floats or not, I do not care, I just would like someone to throw me a rope and keep me from going under.

    Criminal activities should be aggressively and swiftly prosecuted. I know this quote will never happen, but I still feel it none the less. People that run a business like this should have all property and assets confiscated, thrown in jail for a long time, and NEVER allowed to run, own, or be a part of management at another company. It is one thing if a business fails, and you tried to keep it afloat. It is entirely different to have a profitable business and pull the plug to watch it sink.

    My advice, when the toilet stinks, flush it. Good rinse AMP’d.

    PS The investors that seek and are greedy for more and more profits, to the extent they overlook criminal activities, shame on you. You should be made to pay as well. I am tired of businesses that run on the “get rich at everyone else’s expense business model”.

    Ampd got me good. Waiting on that 100$ rebate and then they sent me 2 text saying that they would give me 120$ worth of minutes instead of waiting for my rebate, via text message. I figured it was odd but said ok via text message also, and they said they will credit my account 60$ this month adn 60$ next month. So i got my first 60$ of mins and a week later my service will be terminated.... My other 60$ and the 60$ recived would be nice…
    i want my money.

    Does anyone know who allowes you to use ampd phones for their services?

    Problem with a class action lawsuit is that the lawyer is the only one who will get any real money, the rest of us will get a check for $23. I call for a criminal investigation, this company was a scam from the start.

    Going to their site reveals that they are “potentially” disconnecting service on July 24, 2007. Customer service will be available to the close of business on July 23,2007 and that they are currently in discussion with “several” companies about purchasing Ampd. It also states that If you have an outstanding unpaid credit, rebate or refund due to you, to be considered for payment, you will need to file a claim.
