With such a competitive space and only two main research/data agencies in the space, this was bound to happen: Telephia, one of the research and data companies, has filed a lawsuit against competitor M:Metrics with the U.S. District Court, Northern District of California for violating its IP. The complaint asserts that “M:Metrics has engaged in acts of patent infringement in connection with the development and distribution of smartphone metering software (distributed via Mobilepanel)”. The complaint is based upon patents which Telephia holds in the area of metering mobile devices, including:
—#6,745,011 B1 - “System and Method for Measuring
Wireless Device and Network Usage and Performance Metrics.” Issued June 1, 2004
—#6,754,470 B2 - “System and Method for Measuring Wireless Device and Network Usage and Performance Metrics.” Issued June 22, 2004
Telephia is seeking permanent injunction against M:Metrics infringement on the company’s patent rights.
I’ve put in a query to M:Metrics people and we’ll hear back from them….
