Summary Judgment Dismisses Nielsen Mobile’s Patent Infringement Case Against M:Metrics

We wondered about the status of this lawsuit when Telephia was bought by Nielsen earlier this year….Telephia is now called Nielsen Mobile. Now the status is clearer: the court has ruled that M:Metrics does not infringe Telephia’s patent. In awarding M:Metrics’ petition for partial summary judgment, the court ruled that Telephia’s claims “have been proven by M:Metrics to be either factually baseless or so highly attenuated that they fail to raise any issue of material fact.”

Last year Telephia had filed a lawsuit with the U.S. District Court, Northern District of California for violating its IP. The complaint asserted that “M:Metrics has engaged in acts of patent infringement in connection with the development and distribution of smartphone metering software (distributed via Mobilepanel)”.
