Lawsuits Between AT&T And Verizon Over 3G Ads ‘Voluntarily’ Dismissed
AT&T (NYSE: T) is no longer battling Verizon Wireless in court over whether Verizon Wireless should have to take its ads off the air that compare its 3G network to AT&T’s.

Two cases have been dismissed. One in U.S. District Court in Atlanta, where AT&T was suing Verizon Wireless, and one in U.S. District Court in New York, where AT&T was suing Verizon, and Verizon had filed a counter-claim. In both cases, voluntary dismissals were filed that says the case has been dismissed without prejudice. AT&T emailed the documents to reporters who requested them. Verizon Wireless declined to comment.
The voluntary dismissals are somewhat of an anti-climatic ending to the spat, which began in October when Verizon Wireless started running an ad campaign that compared its 3G coverage map to AT&T’s map, and was claiming to have five times more coverage than AT&T.
Verizon was always confident that it would prevail because AT&T was never contesting the accuracy of Verizon’s statements—its argument was merely that the ads are misleading, and could damage the company during the critical holiday period. Verizon’s response it sent to the court stung: “AT&T did not file this lawsuit because Verizon’s ‘There’s A Map For That’ advertisements are untrue; AT&T sued because Verizon’s ads are true and the truth hurts.”
The judge did not grant a temporary restraining order that would force Verizon to stop showing the ads until the matter is settled in court. Although AT&T vowed to continue the legal fight, the two have now resolved things by dismissing the cases without prejudice. Perhaps, AT&T feels more vindicated now that it has launched its own counterattack. Both AT&T and Apple (NSDQ: AAPL) have started running ads that show the virtues of the company’s network, including rollover minutes and simultaneous voice and data. AT&T’s ads feature actor Luke Wilson.
However, it probably didn’t help yesterday when Consumer Reports ranked AT&T dead last for customer network satisfaction in most markets, where Verizon Wireless came in first.
