Dutch Court Dismissed Nokia Suit Against Qualcomm

A Dutch court has dismissed a lawsuit by Nokia (NYSE: NOK) against Qualcomm, (NSDQ: QCOM) ruling that the court did not have jurisdiction on Nokia’s claims outside of the Netherlands. It also ruled that “Nokia had not presented enough information on the specific patents and licensing agreements, making it difficult for the court to rule without making broad assertions” reports Reuters. Naturally Qualcomm is crowing about this: “This is the second time in as many months that a court in Europe has rejected Nokia’s attempts to have a declaration of exhaustion against Qualcomm’s patents,” a Qualcomm spokesman said in a prepared statement, refering to a German court dismissing a similar lawuit last month on similar grounds. Nokia pointed out that the dismissals were based on the scope of the courts rather than the issues raised about the patents. Nokia wants some Qualcomm patents to be ruled exhausted, and also that Qualcomm should be prevented from charging twice for its patents—both the chipset suppliers and the handset makers.
